Terms of Service

These Terms of Service ("Terms") govern your use of the Rooste web application at rooste.app (the "Service") operated by Rooste ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of Service

Rooste is a financial planning tool for homeowners considering a sell-to-buy transaction. The Service provides estimated calculations, scenario comparison, and workspace organization tools. Rooste is not a real estate brokerage, lender, financial advisor, or licensed professional service. The Service does not provide financial, legal, tax, or real estate advice.

2. Disclaimer of Financial Advice

All calculations, estimates, and projections provided by the Service are for informational and planning purposes only. They are based on the assumptions and inputs you provide and should not be relied upon as a substitute for professional financial, legal, or real estate advice. Actual sale proceeds, mortgage terms, closing costs, and monthly payments will vary based on market conditions, lender terms, and other factors outside of Rooste's control.

You acknowledge that Rooste's estimates are not binding quotes, appraisals, loan pre-approvals, or guaranteed outcomes. Always consult with qualified professionals (real estate agents, mortgage lenders, financial advisors, attorneys) before making financial decisions.

3. User Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to update it as needed. You must be at least 18 years old to use the Service.

Free Tier

The free tier provides limited access to the Service at no cost. Free tier includes basic calculator functionality, up to 2 scenarios, 1 community, 3 contacts, 3 properties, and 5 AI credits. Free tier features may change at our discretion.

Move Pass

The Move Pass is a one-time purchase of $49 that provides full access to all features for 12 months from the date of purchase, plus 100 AI credits. The Move Pass is non-recurring and does not auto-renew. After 12 months, your account reverts to the free tier, but any purchased AI credits remain available.

AI Credit Packs

Additional AI credits may be purchased in packs of 25 credits for $5. Purchased credits do not expire and remain available regardless of your plan status.

Refunds

All purchases are final. Because the Service provides immediate access to digital features and AI processing upon purchase, we generally do not offer refunds. If you believe a charge was made in error, contact us at support@rooste.app within 14 days of the purchase.

6. AI Features and Limitations

The Service includes AI-powered features (document scanning, listing import, chat assistant) powered by third-party AI models. AI-generated outputs may contain errors, inaccuracies, or incomplete information. You are responsible for reviewing and verifying all AI-extracted data before relying on it for planning purposes.

AI features consume credits from your account. Each AI action (document scan, chat message, URL import) uses one credit. Credits are deducted at the time of the request regardless of the quality of the result.

7. Intellectual Property

The Service, including its design, code, branding, and content, is owned by Rooste and protected by copyright and other intellectual property laws. You retain ownership of all data and content you input into the Service (financial information, contacts, documents). By using the Service, you grant us a limited license to process your data solely to provide the Service to you.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOSTE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Rooste is not responsible for financial decisions you make based on calculations or information provided by the Service. The Service is a planning tool, not a professional advisory service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Account Termination

You may delete your account at any time through the Profile & Account settings. Upon deletion, all your data will be permanently removed from our systems.

We may suspend or terminate your account if you violate these Terms or if we determine that your use of the Service poses a risk to the Service or other users. We will make reasonable efforts to notify you before any suspension or termination.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Texas.
